This document is an adaptation to the situation in Calais of the brochure “From arrest to detention center – Facing the deportating machine when undocumented”, originally written in the Paris region.
It aims to collect legal and practical information useful to understand your rights and try to be released in case of arrest and possible deportation. The brochure has been written on the basis of legal texts and first- and second-hand experiences. The French legal system doesn’t leave many opportunities for gaining freedom in such cases, and some of the advice reported here are not legal or legally allowed. This guide is very dense, and practices change from one case to another, and from one prefecture to another. They are therefore not exhaustive.
Moreover, “it’s you and your good luck”: depending on the prefecture, cops, lawyers and judges that you meet, what happens to one person is not guaranteed to happen in the same way to another.
These pages are not only a guide for those who can be deported, but also an act against national borders. This text is not only concerned with providing tools to escape State control, but it also wishes to oppose it, by blocking its deporting machine.
Taking part in a struggle, refusing to board a plane, spending time in jail, and everything that might happen to you while you are in a detention center, is not necessarily going to be a problem when you will try to obtain a residency permit later on.

Ce document est une adaptation à la situation à Calais de la brochure « De l’arrestation au centre de rétention – Faire face à la machine à expulser quand on est sans-papiers », initialement écrite en région parisienne.
Il vise à rassembler des informations juridiques et pratiques pour comprendre et tenter de s’en sortir en cas d’arrestation et de risque d’expulsion. Il est conçu à partir de la lecture des textes de loi et de retours d’expérience. La loi ne nous laissant pas beaucoup de place pour nous en sortir, un certain nombre de conseils sont en dehors de la légalité. Ce guide est très condensé, et les pratiques évoluent selon le moment et les préfectures. Il n’est donc pas complet.
Par ailleurs, « c’est toi et ta chance » : selon la préfecture, le flic, l’avocat et le juge sur lequel vous tombez, ce qui vous arrivera n’arrivera pas forcément à quelqu’un d’autre.
Cette brochure n’est pas juste un guide à l’usage des personnes susceptibles d’être expulsées, mais aussi une initiative contre les frontières. Il s’agit autant de fournir des outils pour échapper à l’État que de s’opposer à lui, d’enrayer sa machine à expulser.
Participer à des luttes, refuser d’embarquer, faire de la prison, et tout ce qui pourrait arriver pendant que vous êtes au centre de rétention ne posera pas forcément de problème pour votre accès à un titre de séjour plus tard.

En mars 2023, les états français et britannique ont annoncé l’ouverture prochaine d’un nouveau centre de rétention administrative (CRA) sur le littoral nord de la france, financé par le royaume-uni.
Les CRA sont des prisons où l’état français enferme les personnes qui n’ont pas les « bons papiers » dans l’attente de leur expulsion du pays. Il en existe déjà plusieurs dizaines dans toute la france, dont un à Coquelles, à côté de Calais. Les violences et mauvais traitements contre les prisonnier-es y sont quotidiens.
Ce nouveau projet s’inscrit dans les logiques racistes et sécuritaires de la france et du royaume-uni, comme de l’ensemble des pays européens, qui dépensent des milliards d’euros dans la militarisation des frontières, le flicage et le harcèlement des personnes exilées.
Alors que la majorité des habitant-es de la région souffrent, comme les personnes exilé-es, d’une grande précarité, il est temps de mettre un terme aux politiques d’enfermement et de déportations. En plus d’être cruelles et inhumaines, ces politiques sont coûteuses et inefficaces : en dépit de tous les mauvais traitements qu’elles subissent ici, les personnes exilé-es continuent de venir pour fuir pauvreté et les conflits, dont les états occidentaux sont souvent en grande partie responsables.
Nous appelons à multiplier les initiatives pour empêcher, par tous les moyens nécessaires, l’ouverture de ce nouveau CRA, ou tout autre lieu de ce type partout sur le territoire, ainsi qu’à pousser à la fermeture de ceux déjà existants.

In March 2023, the French and British states announced the upcoming opening of a new administrative detention center (CRA) on the northern coast of France, financed by the United Kingdom.
CRAs are prisons where the French state locks up people who don’t have the “good papers” while awaiting their deportation from the country. There are already dozens throughout France, including one in Coquelles, near Calais. Violence and mistreatment against prisoners is a daily occurrence there.
This new project is part of the racist and securitarian policies of France and the United Kingdom, as well as all European countries, which spend billions of euros on the militarization of borders, policing and harassment of exiled people.
While the majority of the region’s inhabitants suffer, like people on the move, from great precariousness, it is time to put an end to the policies of confinement and deportations. In addition to being cruel and inhumane, these policies are costly and inefficient: despite all the mistreatment they suffer here, exiled people continue to come to escape poverty and conflicts, from which Western states are often largely responsible.
We call for increased initiatives to prevent, by all means necessary, the opening of this new CRA, or any other place of this type anywhere in the territory, as well as to push for the closure of those already existing.
