Call to Canterbury Crown Court

Comrades from Captain Support call you to Canterbury Crown Court from 10am Monday 29/01/24 to support our friend Ibrahima Bah who stands accused of steering a dinghy which collapsed in the Channel 14/12/22 and led to the loss of at least four lives.

This will be Ibrahima’s second trial. The first trial in Summer 2023 ended with a hung jury; effectively condemning Ibrahima to further 6 months of waiting in prison before this retrial. 

He is charged with four counts of manslaughter as the prosecution alleges his dangerous driving led to the loss of life. Ibrahima described to the first jury he was assaulted and threatened with death if he did not obey the organisers of the journey and play a role in steering the dinghy. We condemn the scapegoating of travellers who are denied access to alternative means of crossing. No lives would be lost in this way if everyone was allowed access to the ferry.

Analysis from Alarmphone with support from LIMINAL shows that the dinghy was advancing across the Channel despite some water entering over the sides from the waves. Unusually, no French boat was escorting the dinghy, nor were there any surveillance aircraft in the sky to spot them as is standard. Calls for assistance to the French Coastguard did not result in a French search and rescue asset being deployed. The travellers tried to attract attention of a French fishing boat but no help was offered. On the approach to another UK flagged fishing vessel, the Arcturus, the passengers became more desperate and began to panic. One man jumped into the water to swim to the fishing boat, while everyone else stood up and began shouting and attract the crew’s attention. Testimonies from other survivors describe this moment as the cause of the shipwreck. 

“Everyone stood up and the boat fell apart, so what happened was the bottom of the boat fell apart, the round part of the boat the side that were inflated and everyone had to hold onto this.”

The Alarmphone report raises questions about the role of the fishing crew and whether a faster and more appropriate rescue could have prevented loss of life. Four people’s bodies were recovered including the body of Ibrahima’s close friend, Alihaji Ba, from Guinea, a teenager from Guinea called Moussa, as well as an Afghan man named Hajratullah Ahmadi.  Ultimately, it’s the border apartheid which took their lives.

After surviving this incident Ibrahima was arrested and taken to custody. We have visited him every month since and he has told us he is looking forward to seeing friendly faces in the public gallery from Monday. The trial is expected to last three weeks. Les camarades de Captain Support vous appellent à se retrouver à Canterbury Crown Court à partir de 10h le lundi 29/01/24 pour soutenir notre ami Ibrahima Bah qui est accusé d’avoir piloté un canot pneumatique qui a fait naufrage dans la Manche le 14/12/22 et qui a causé la perte d’au moins quatre vies.

Il s’agit du deuxième procès d’Ibrahima. Le premier procès, qui s’est tenu à l’été 2023, s’est soldé par une fin de non-recevoir du jury, ce qui condamne Ibrahima à six mois supplémentaires d’attente en prison avant ce nouveau procès. 

Il est accusé de quatre chefs d’accusation d’homicide involontaire, l’accusation alléguant que sa ‘conduite dangereuse’ a entraîné la perte de vies humaines. Ibrahima a expliqué au premier jury qu’il avait été agressé et menacé de mort s’il n’obéissait pas aux organisateurs du voyage, en participant à la conduite du canot pneumatique. Nous condamnons la désignation de boucs émissaires parmi les voyageurs qui se voient refuser l’accès à d’autres moyens de traverser. Aucune vie ne serait perdue de cette manière si tout le monde pouvait accéder au ferry.

L’analyse d’Alarmphone, avec le soutien de LIMINAL, montre que le canot pneumatique avançait dans la Manche malgré l’eau qui pénétrait par les côtés à cause des vagues. Fait inhabituel, aucun bateau français n’escortait le canot pneumatique, et aucun avion de surveillance n’était présent dans le ciel pour les repérer, comme c’est habituellement le cas. Les appels à l’aide adressés aux garde-côtes français n’ont pas donné lieu au déploiement d’une unité de recherche et de sauvetage française. Les voyageurs ont tenté d’attirer l’attention d’un bateau de pêche français, mais aucune aide ne leur a été proposée. À l’approche d’un autre navire de pêche battant pavillon britannique, l’Arcturus, les passagers sont devenus désespérés et ont commencé à paniquer. Un homme s’est jeté à l’eau pour nager jusqu’au bateau de pêche, tandis que tous les autres se sont levés et ont commencé à crier pour attirer l’attention de l’équipage. Les témoignages d’autres survivants décrivent ce moment comme la cause du naufrage. 

“Tout le monde s’est levé et le bateau s’est effondré, donc ce qui s’est passé, c’est que le fond du bateau s’est effondré, la partie ronde du bateau, le côté qui était gonflé et tout le monde a dû s’y accrocher. “

Le rapport Alarmphone soulève des questions sur le rôle de l’équipage du bateau de pêche et sur le fait de savoir si un sauvetage plus rapide et plus approprié aurait pu éviter des pertes de vies humaines. Les corps de quatre personnes ont été retrouvés, dont celui d’un ami proche d’Ibrahima, Alihaji Ba, originaire de Guinée, d’un adolescent guinéen appelé Moussa, ainsi que d’un Afghan nommé Hajratullah Ahmadi.  En fin de compte, c’est l’apartheid frontalier qui leur a coûté la vie.

Après avoir survécu à cet incident, Ibrahima a été arrêté et placé en détention. Depuis, nous lui avons rendu visite tous les mois et il nous a dit qu’il se réjouissait de voir des visages amicaux dans la tribune du public à partir de lundi.
